New York overtime rules
Most non-exempt employees in New York must be paid 1.5 times their regular rate for hours over 40 in a workweek. Residential employees who live in the employer's home, such as live-in domestic workers, earn overtime after 44 hours. New York does not require daily overtime.
New York also has a "spread of hours" rule: employees paid at the minimum wage get one extra hour of pay at the minimum wage on any day their workday spans more than 10 hours from start to finish. This calculator does not add spread of hours pay.
Example: a 45-hour week
Five 9-hour days at $17.00 an hour is 45 hours: 40 regular and 5 overtime. Pay: 40 × $17.00 + 5 × $25.50 = $807.50.
