Florida overtime law
Florida does not have a separate state overtime law for private employers. The federal Fair Labor Standards Act applies: non-exempt employees earn at least 1.5 times their regular rate for hours over 40 in a workweek.
- No daily overtime and no double time requirement.
- Overtime is based on a fixed 7-day workweek. Two weeks cannot be averaged together.
Example: a 44-hour week
Four 9-hour days and one 8-hour day at $15.00 an hour is 44 hours: 40 regular and 4 overtime. Pay: 40 × $15.00 + 4 × $22.50 = $690.00.
